SECTION 1 - INTERPRETATION OF REGULATIONS
DEFINITIONS
1. In these Regulations, which are issued in accordance with Rule 32.1 of the Constitution,
unless inconsistent with the content or subject matter:-
“Act” shall mean the Associations Incorporation Act, 1981
“Club” means the Beaumaris Bowls Incorporated (BBC Inc).
“Board” means the Board of Management of BBC Inc
“Constitution” means the Constitution of the Club
“Rule” means a Rule of the Constitution
2. Other definitions are as per rule 4 of the Constitution
3. If in their interpretation the Regulations conflict with the Constitution then the
Constitution shall apply. Non compliance with the Regulations shall not render
any proceedings void unless the Board so directs after examination of the
Regulations and consultation with the Bowls Committee, if appropriate.
GENERAL PROVISIONS :
1. These Regulations are issued by the Board and may be amended by the Board.
It is intended that they complement the Constitution and to be consistent with
the relevant provisions of Bowls Victoria Rules. It is expected that they will be
reviewed by the Board and the Bowls Committee as appropriate with
recommendations being made to the Board as circumstances require.
2. Green fees and all other charges (e.g. afternoon teas, meals, bar, etc.) shall be
determined by the Board taking into account the proposals and
recommendations of the Bowls Committee, where appropriate.
3. The Laws of the game of bowls as adapted from time to time by Bowls Victoria
shall apply to all games under the control of the Club.
SECTION 2 - ADMINISTRATION & MANAGEMENT
PART I MEMBERSHIP
1. CLASSES OF MEMBERSHIP :
In addition to the classes of membership in accordance with Rule 5.1 of the
Constitution, the Club shall consist of the following classes of members:-
Honorary Members
Restricted Members
Student Members
Social Members
2. HONORARY MEMBERS:
1. Honorary membership shall be granted to :
(i) A person who is a financial member of any Bowls Club affiliated
with the national bodies governing bowls in Australia.
(ii) A member or official of any club visiting the Club premises for the
purpose of sporting competitions.
2. Honorary membership may be cancelled at any time by the Board.
3. Honorary members shall not be required to pay any entrance fees, annual
subscriptions or levies and are exempt from the provisions of Rule 6.
4. Honorary members shall not be entitled to attend or vote at any meeting
of the Club.
3. RESTRICTED MEMBERS:
1. Any member of the Club who, because of age or infirmity or other cause,
desires to continue association with the Club other than as an Affiliated
Member may make written application to the Board to be reclassified as a
Restricted Member.
2. Such reclassification, if granted by the Board, shall take effect from the
commencement of the next Financial Year.
3. The Board shall determine from time to time the limit of the use of the
Club’s facilities by Restricted Members and the number of organised
games in which Restricted Members can participate in each Financial
Year.
4. Restricted members shall be entitled to hold office, attend and vote at
meetings of the Club.
5. The total number of Restricted Members shall not at any time exceed
twenty-five (25) unless otherwise determined by the Board.
4. STUDENT MEMBERS:
1. Any person aged not more than 18 years or, in the case of a full time
student, not more than 25 years who is nominated and elected for
membership as provided in Rule 5.2 is entitled to be a Student Member of
the Club on payment of the prescribed fees for Student Members.
2. Student Members shall be entitled to play bowls on the Club greens and
otherwise participate in the bowls and social activities of the Club subject
to such restrictions as to the use of the Club's bowling and other facilities
as may be prescribed from time to time by the Board.
3. Student members shall not be entitled to attend or vote at meetings of the Club.
4. On attaining the age of 18 years, 25 years in the case of a full time student,
the Student membership will cease and the member may apply for
election to other membership classes.
5. SOCIAL MEMBERS
1. Any member of the Club who, because of age or infirmity or other cause,
desires to continue association with the Club but not as an Affiliated or
Restricted member may make written application to the Board to be
reclassified as a Social Member.
2. Such reclassification, if granted by the Board, shall take effect from the
commencement of the next Financial Year.
3. Any person over the age of eighteen may on application to the Board be
elected as a social member.
4. Social members shall be entitled to hold any office on the Board but not
on the Bowls Committee. They are entitled to attend General Meetings
and vote on all matters except those relating to Bowling including the
election of Bowling officials.
5. Social members shall not be permitted to use the greens.
6. Social members shall be subjected to such restrictions as to the use of the
Club facilities as may be prescribed or as determined from time to time by
the Board.
7. The total number of Social Members shall not at any time exceed fifty
(50) unless otherwise determined by the Board.
6. LIFE MEMBERS
1. Life members shall not be relieved of any financial obligations other than
the annual subscription and levies raised from time to time.
2. The total number of Life Members shall not at any time exceed ten (10)
unless otherwise determined by the Board.
2. RENEWAL OF MEMBERSHIP
1. RENEWAL OF MEMBERSHIP
Unless membership is terminated in terms of the Constitution or the
Regulations, all classes of members shall not be required to reapply for
membership each Financial Year.
2. REFUSAL TO RENEW MEMBERSHIP
1. Prior to the expiration of any financial year, the Board, if it is of the
opinion that it is not in the interest of the Club that a person should
continue to be a member, may decline to accept any further subscriptions
from such person. The Secretary shall notify such person of this decision
and they shall cease to be a member of the Club at the expiration of the
current Financial Year.
2. The Board shall not be obliged to assign any reason for its decision.
PART II MEETINGS OF MEMBERS
3. ANNUAL GENERAL MEETINGS:
1. Business of Annual General Meeting :
The business to be transacted at the Annual General Meeting shall be in the
following order :-
(i) Reading of notice convening the meeting;
(ii) Confirmation of minutes of previous Annual General
Meeting and Special General Meeting (if any);
(iii) Consider the Annual Report;
(iv) Consider the statement submitted by the Club in accordance
with section 30(3) of the Act which includes the Balance
Sheet and Statement of Accounts;
(v) Consider a forecast Profit and Loss Account for the current
Financial year;
(vi) Presentation of Auditor's Annual Report;
(vii) Consideration of adoption of Balance Sheet and
Statement of Accounts, forecast Profit and Loss Account
and Auditors’ report;
(viii) Declaration of the polls;
(ix) Election of Life Members (if any);
(x) Nomination and election of Auditors;
(xi) Transact any other business affecting the interest and
welfare of the Club of which notice has been given according
to the Regulations.
2. Notice of Meeting :
The notice of the Annual General Meeting shall be accompanied by :
(i) the Annual Report,
(ii) the statement submitted by the Club in accordance with
section 30(3) of the Act which includes the Balance Sheet
and Statement of Accounts,
(iii) the minutes of previous Annual General Meeting and
Special General Meeting (if any),
(iv) a forecast Profit and Loss Account for the current Financial year.
PART III MANAGEMENT OF THE CLUB
4. BOARD
1. Restrictions and Attendance :
1. There shall be no restriction on any Director of the Board except the
Chairman from holding dual office on any other elected Committee or
section of the Club.
2. Any Director of the Board who fails to attend for three consecutive
meetings without leave or apology shall cease to be a Director.
2. Chairman :
1. The duties of the Chairman shall be to preside at all meetings of the Board
and meetings of the Club and to regulate and to keep order in all
proceedings and carry into effect the Constitution and Regulations of the Club.
2. The Chairman may attend ex officio any committee or meeting of members of the Club.
3. Secretary :
The duties of the Secretary are:-
1. Attend all meetings of the Board and Annual or Special General Meetings
of the Club.
2. To be responsible for recording the minutes of all meetings and retain
them as part of the Club’s records in hard copy and electronic format.
3. Conduct all correspondence in connection with the general business of
the Club.
4. Prepare for submission to the Annual General Meeting the report of the
Board activities during the year.
5. Keep a register of the members of the Club setting forth the name in full
and address of each member and the date of the latest payment of
subscriptions; such register to be open to the inspection of the members.
6. Carry out those duties usually associated with the office of Secretary in
accordance with the policies of the Club and the Board.
7. Except as provided or otherwise determined by the Board, the Secretary
shall keep in his custody or under his control, at the Club premises all
books, documents and securities of the Club.
4. Treasurer :
The duties of the Treasurer shall be:-
1. To receive all moneys belonging to the Club and within a reasonable time
to deposit or arrange for the deposit of such moneys with the Club's
bankers.
2. To pay all accounts as and when they fall due.
3. To develop and maintain appropriate financial systems and procedures
for the recording of all monies received and expended.
4. To prepare and submit financial statements to each Annual General
Meeting.
5. To prepare a budget for the next financial year for consideration by the
Board when considering any increase in fees
6. To produce a statement in accordance with the Act of cash transactions
and of the financial position of the Club including a bank balance at each
monthly meeting of the Board.
7. All records and accounts dealing with the financial affairs of the Club
shall be kept by the Treasurer and these shall be open to the inspection of
the Board and the Auditors at any time.
5. Honorary Solicitor:
An Honorary Solicitor to the Club may be appointed by the Board upon such
terms and for such period as the Board shall direct.
PART IV FINANCIAL
5. Source of Funds :
Any funds derived from activities undertaken by any committee or any group
of members shall be the property of the Club and shall be handed to the
Treasurer properly reconciled promptly following the completion of the
activity.
6. Banking Accounts:
The banking accounts of the Club shall be kept with such Banks as shall from
time to time be appointed by the Board and all moneys shall be banked
therein.
7. Authorising Expenditure:
1. No expenditure exceeding $500 shall be entered into without the consent
of the Board.
2. All accounts shall be endorsed by the person authorising the expenditure
before payment is made.
8. Liability Of Members:
If a member of any classification by the breach of the Constitution or these
Regulations or by any unlawful act, causes the Club or any officer of the Club
to pay any money, such member shall be civilly liable to the Club or such
officer for the amount so paid.
9. Audit:
1. Two Auditors shall be elected at each Annual General Meeting. Such
Auditors shall not be members of the Board.
2. Nominations for such office shall be taken at the Annual General Meeting
each year. The first 2 nominations accepted by the Chairman of the meeting
shall be considered as elected.
3. The Auditors shall have power at all times to examine all books and
documents of the Club and shall also as soon as convenient after the close of
the financial year in each year audit a Statement of Receipts and Expenditure
and Balance Sheet setting forth all the financial business of the Club since the
end of the financial year just closed.
4. A report signed by the Auditors shall be submitted to members at the
Annual General Meeting covering all aspects of Club’s finance for
the preceding year. This report shall be embodied in the minutes of each Annual
General Meeting.
PART V GENERAL
10. CLUB HOUSE:
1. The Club House shall be open to members for such times and on such
conditions as may be decided by the Board from time to time.
2. The total number of persons permitted in the Club house at the one time
shall not exceed 250.
3. Members are not permitted to exhibit or cause to be exhibited on the
Notice Boards of the Club or any other place within the Club
advertisements or notices for which prior approval has not been obtained
from the Board or Secretary.
11. CLUB COLOURS:
The colours of the Club shall be light blue, dark blue, and gold
12. GAMBLING, OBJECTIONABLE LANGUAGE:
On the Club premises
(i) no objectionable language or behaviour, and/or
(ii) unlawful gambling or betting
shall be allowed.
SECTION 3 – BOWLING
PART VI BOWLS ADMINISTRATION
13. BOWLS COMMITTEE
1. Duties and Responsibilities :
1. The Bowls Committee shall be responsible to the Board for the
management and conduct of all bowls activities including pennant and
social bowls, Club championships, Association and Club events and any
other special events approved by the Board and other affairs and
activities associated with Bowls Victoria.
2. The Board shall determine how the duties and powers of the Bowls
Committee shall be exercised.
2. Composition of Bowls Committee :
The Bowls Committee shall consist of :
Director, Ladies’ Bowls
Director, Men’s Bowls
Co-ordinator, Pennant Selection
Co-ordinator, Coaching
Co-ordinator, Ladies’ Match
Co-ordinator, Men’s Match
Co-ordinator, Umpires and Measurers
Greens Director
Bowls Secretary
3. Appointed Directors :
The Director, Ladies’ Bowls and the Director, Men’s Bowls shall be
automatically appointed as Appointed Directors of the Board in terms of
Rule 15.2.2. of the Constitution, and shall take up office immediately
following their election.
4. Election and Appointment of Officers :
The method of election of members of the Bowls Committee shall be :-
1. Director Ladies’ Bowls, Director Men’s Bowls, Co-ordinator Pennant
Selection, - carried out in the same manner as the election of Elected
Directors in accordance with Rule 16 of the Constitution except that the
duties of the Board shall be carried out by the Bowls Committee.
2. Co-ordinator Ladies’ Match, Co-ordinator Men’s Match, Co-ordinator
Coaching and Co-ordinator Umpires and Measurers, Greens Director,
Bowls Secretary – by the Bowls Committee.
5. Casual Vacancy :
If a position on the Bowls Committee becomes vacant in the same
circumstances as those described in Rule 17 of the Constitution (except
sub-rule 2. and 8.), or in the event of a casual vacancy in the Bowls
Committee, the Bowls Committee may appoint an appropriate member to
the vacant office and the person so appointed may continue in office up to
the end of the term of the Committee member being replaced.
6. Quorum :
Five (5) Members shall constitute a quorum for the transaction of the
business of a meeting of the Bowls Committee.
No business shall be transacted unless a quorum is present and if within
half an hour of the time appointed for the meeting a quorum is not present, the meeting
shall stand adjourned to the same place and at the same hour of the same day in the
following week, or any date, time and place determined by the Chairman.
The Bowls Committee may act notwithstanding any casual vacancy. However,
if there are casual vacancies such that the number of remaining members is not
sufficient to constitute a quorum at a meeting of the Bowls Committee, those members
may act only for the purpose of increasing the number of members to a number
sufficient to constitute such a quorum.
7. Procedure at Bowls Committee Meetings :
Procedure at Bowls Committee meetings shall be as described in Rule 18.1
and 18.3 of the Constitution, except that any reference to “Directors” shall
mean “Members of the Bowls Committee” and any reference to “the
Board” shall mean “The Bowls Committee”.
8. Delegated Powers and Duties :
1. The Bowls Committee shall have the power to delegate its functions in
the same manner as Rule 20.1 of the Constitution except that any
reference to the “Board” shall mean the ”Bowls Committee”.
2. The Exercise of Delegated Functions and Procedure of Delegated Entity
shall be as Rule 20.2 and Rule 20.3 respectively of the Constitution.
3. Unless otherwise determined by the Board, there shall at all times be
the following sub-committees :
(i) Saturday Pennant Selection
(ii) Tuesday Pennant Selection
(iii) Men’s Match
(iv) Ladies’ Match
(v) Greens
4. The Director, Men’s Bowls and Director, Ladies’ Bowls may attend ex
officio any committee to which powers have been delegated by the Bowls
Committee.
9. Removal of Members of Bowls Committee :
The members in general meeting may by resolution remove any members
of the Bowls Committee. The vacancy so created shall be filled by the
Bowls Committee in accordance with Rule 15.4
10. Chairman, Bowls Committee :
1. The position of Chairman, Bowls Committee shall be filled by the
Director, Men’s Bowls and Director, Ladies’ Bowls in alternate years.
2. The Director not serving as Chairman shall serve as Vice-Chairman.
3. The duties of the Chairman shall be to preside at all Committee
Meetings, to regulate and keep order in all proceedings of
the Committee and carry into effect the requirements of the Club
Constitution and Regulations in relation to all such proceedings.
11. Bowls Secretary, Bowls Committee :
The duties of the Bowls Secretary are :-
(i) to attend all meetings of the Bowls Committee;
(ii) to be responsible for recording the minutes of all meetings;
(iii) to conduct all correspondence in connection with the operation of the
Committee;
(iv) to collate any submissions made on behalf of the Committee to the
Board;
(v) to provide copies of the minutes and reports of all meetings to the
Board Secretary;
(vi) to arrange the affiliation of members with Bowls Victoria;
(vii) to generally carry out those duties usually associated
with the office of Bowls Secretary in accordance with the policies and
practices of the Club and the Bowls Committee.
14. DELEGATES OF CLUB :
The Bowls Committee shall appoint Delegates to attend meetings and
events on its behalf from time to time. This shall include, but not be limited to, Bowls
Victoria meetings and Region and Division meetings.
The Club shall advise Bowls Victoria prior to a relevant meeting or event
who its Delegates will be. If the Club does not provide notification to Bowls Victoria,
the Chairman and Vice-Chairman of the Bowls Committee shall be deemed to
be the Delegates.
15. SUB-COMMITTEES
1. Pennant Selection Committees :
1. A Tuesday and Saturday Pennant Selection Committee shall each be
elected in the same manner as the election of Elected Directors in
accordance with Rule 16 of the Constitution.
2. The composition of such Committees shall be at the discretion of the
Bowls Committee but each shall not be less than 3 members.
3. The duties of the Pennant Selection Committees shall be :-
(i) to select teams and sides to represent the Club in pennant fixtures
under the control of Bowls Victoria in accordance with Club policy
which calls for selection on the basis of current form, performance
and compatibility so that the best players are chosen;
(ii) to appoint Side/Team captains and ensure that they are properly
briefed on the duties and responsibilities of the position;
(iii) to review player’s handicaps at least annually;
(iv) to select or recommend other playing representatives of the Club.
(v) to decide from those made available by the Greens Director
(or deputy) the rinks on which Pennant fixtures shall be played;
4. In the event of any member or members of a Pennant Selection
Committee vacating his or her position for any reason whatsoever, then
such vacancy or vacancies shall be filled by another member or
members to be appointed by the Bowls Committee.
5. Subject to the approval of the Bowls Committee, the Pennant Selection
Committees shall have power to co-opt any member to assist in its duties.
6. The Pennant Selection Committees shall be responsible to the Bowls
Committee for ensuring that their actions are in the best interests of
the Club and in compliance with the requirements of Bowls Victoria.
2. Match Committees :
1. A Men’s and Ladies’ Match Committee shall each be elected by the
Bowls Committee at their first meeting following the Annual Meeting
2. The composition of such Committees shall be at the discretion of
the Bowls Committee but each shall not be less than 3 members.
3. The duties of the Match Committees shall be :-
(i) to arrange and manage the appropriate calendar of events
for the following year;
(ii) to arrange teams for and control all appropriate fixtures;
(iii) to make the draw and determine handicaps for competitions.
4. In the event of any member or members of the Match Committee
vacating his or her position for any reason whatsoever, then such
vacancy or vacancies shall be filled by another member or members
to be appointed by the Bowls Committee.
5. Subject to the approval of the Bowls Committee, the Match Committees
shall have power to co-opt any member to assist in conducting events.
6. The Match Committees shall be responsible to the Bowls Committee
for the conducting of tournaments and competitions in accordance with
the calendar of events and for the compliance of such tournaments
and competitions with the requirements of Bowls Victoria
3. Greens Committee :
1. The Bowls Committee shall appoint a Greens Committee, one of
whom shall be designated Greens Director.
2. The Greens Committee shall have full control and supervision of the
playing area and any member of the Greens Committee shall have the
power to prevent play at any time if it is considered the playing area
may be injured as a result.
3. In the absence of any member of the Greens Committee, any member
of the Bowls Committee shall have the power to prevent play at any time
if it is considered the playing area may be injured as a result.
4. In all other respects the supervision and control of the playing area
shall be in the hands of the Bowling Committee whose ruling thereon
shall be final.
16. BOWLS VICTORIA
1. The Bowls Committee shall be responsible for maintaining the Club’s
affiliation with Bowls Victoria.
2. In playing bowls, members shall observe the Laws and Rules of the
Game of Bowls.
3. Failure to observe such Laws and Rules will render offending players
liable to disqualification from the match or competition.
4. For as long as the Club is a member of Bowls Victoria it is a condition
of membership of the Club that all members agree to and shall abide by
the Constitution, Rules and By-Laws of Bowls Victoria in force from time
to time.
PART VII CLUB CHAMPIONSHIPS AND EVENTS
17. CLUB CHAMPIONSHIPS
1. Responsibilities of Match Committees :
1. The Match Committees, in consultation with the Bowls Committee, shall
determine the number and nature of Championship events to be held during
the season and be responsible for the preparation of the programme and
any special conditions to apply to any events.
2. The conduct of the championships and annual Club competitions shall be
the responsibility of the Match Committees and no variation to the approved
programme shall be permitted unless due to the non-availability of greens
because of inclement weather. The Match Committees shall not approve an
extension of time for any other reason. It may, at its absolute discretion, permit
the use of a substitute for rounds other than the semi-finals or final in certain
circumstances, provided that the substitute shall not normally play in a higher
position or higher Pennant side than the player being replaced.
3. Any event may be cancelled by the Match Committee when, under prevailing
circumstances, insufficient entries have been received to make it worthwhile.
4. Play in any Club competition may be re-scheduled by the Match Committees
on or before the scheduled date where the proposed date, time or place conflicts
with any Bowls Victoria approved fixture, meeting or function affecting any
of the participants.
2. Conduct Of Club Championship Events :
1. The Match Committees shall allocate rinks for competition play in accordance
with the wishes of the Greens Director, or Duty Greens Committeeman.
2. Should greens be closed on any Club Competition day players must proceed
to the Clubhouse and report to Match Committee.
3. In all competitions, 15 minutes grace will be allowed beyond the specified time
of starting. If, at the end of this period of time the team or player has failed to put
in an appearance the opponent MUST claim a forfeit.
4. In singles events it is the responsibility of players to arrange for markers from
the members of the Club.
5. The Club Championship Singles, Pairs and Triples will be played under the
provisions of the Bowls Victoria Rules for Competitions except that the rounds
which are played each day shall be as programmed or as otherwise determined
by the Match Committee.
6. Two trial-ends shall be permitted prior to the scheduled starting time.
7. The Match Committee shall ensure that a competent marker is made available
for Finals of Club Singles Competitions.
8. No Club Competition matches shall be played on organised Pennant Practice,
Coffee Luncheon or on Sponsored days without the permission of the Match
Committee.
9. Any member who has won the Championship or Minor singles competition of
any affiliated Club is not eligible for the Minor singles competition. Any member is
eligible to play in the Minor singles competition who has not won the Championship
and has a handicap of 5 and under.
10. It is essential that the Singles and Pairs championships be completed in time
for the winners to be entered to play in the Bowls Victoria Champion of Champions
or other events for which they may be nominated to represent the Club by invitation.
If any player so nominated becomes unavailable, the replacement shall be as
determined by the Bowls Committee after consultation with the Match Committee.
18. OTHER BOWLING MATTERS :
1. Social Competition Play:
Trophies or prizes will be awarded in Social Competition events in accordance with
the schedule issued by the Board.
2. Pennant Practice :
The Bowls Committee may set aside days specifically for Pennant practice by
arrangement with the Pennant Committees.
3. Payment of Fines :
Payment of any fines incurred by player(s) for cancellation of, or failure to attend
any State Title Championship Event will be the sole responsibility of the competitor(s).
The Club accepts no liability to pay such fines.
4. Attire :
Regulation Bowls attire must be worn for all organised games, Club events and
Tournaments, and Club Championship finals, unless determined otherwise by
the Match Committee.
5. Inclement Weather :
1. For Pennant matches and other events played under the control of Bowls
Victoria, the procedures laid down by Bowls Victoria shall apply.
2. During Club social games and events not played under the control of Bowls
Victoria, a member of the Match Committee, or, if none are present, the Bowls
Committee may cancel a game before commencement or whilst in progress,
if the general opinion of the players is that the weather is sufficiently inclement
for play.
